Terms of Service

These Terms of Service ("Terms") are an agreement between you and RoushTech, LLC ("Macro Marmot", "we", "us") governing your use of the Macro Marmot apps and website. By creating an account or using Macro Marmot, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

Not medical or nutritional advice

Macro Marmot is a tracking tool, not a medical device or a healthcare provider. The calories, macros, maintenance estimates, projections, and other figures it produces are informational estimates only. They are not medical, nutritional, diagnostic, or treatment advice, and they are not a substitute for the judgment of a qualified physician, dietitian, or other professional.

Always consult a qualified professional before starting any diet, weight-change, or exercise program, especially if you are pregnant or nursing, are under 18, have an eating disorder or a history of one, or have any medical condition. Do not disregard or delay professional advice because of anything in the app. You use Macro Marmot at your own discretion and risk.

Eligibility

You must be at least 13 years old (or the minimum age in your country) and able to form a binding contract to use Macro Marmot. If you are under 18, you should use it only with the involvement of a parent or guardian.

Your account

You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly at support@macromarmot.com if you suspect unauthorized use.

Your content

You keep ownership of the content you create in Macro Marmot, including foods, recipes, photos, and logs. You grant us a non-exclusive, worldwide license to host, store, process, and display that content only as needed to operate the service for you, including syncing it across your devices and, where you choose to make something public, displaying it through a shareable link.

You are responsible for the content you submit, and you agree not to upload anything unlawful, infringing, or that you do not have the right to share.

Acceptable use

Do not misuse the service. In particular, do not: break the law; attempt to access accounts or data that are not yours; probe, scan, or disrupt the service or its infrastructure; scrape or harvest data at scale; resell or redistribute the service; or interfere with other users.

Subscriptions, trials, and billing

Some features require a paid subscription. The current price and any free-trial terms are shown in Google Play and in the app at the time of purchase.

• Billing. Subscriptions are sold and billed through Google Play under Google's terms. Your payment method is charged through your Google account.
• Free trial. If a free trial is offered, you will not be charged during the trial. Unless you cancel before the trial ends, it converts to a paid subscription automatically.
• Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Cancellation. You can cancel anytime in your Google Play account settings. Cancellation stops future renewals; you keep access until the end of the period you already paid for.
• Refunds. Refunds are handled according to Google Play's policies. We may offer refunds at our discretion, but we are not obligated to beyond what the store and applicable law require.
• Price changes. We may change subscription prices. Changes apply to future billing periods, and we will give notice as required by Google Play and applicable law. Existing subscribers may be handled under the store's rules for grandfathered pricing.
• Complimentary access. We may grant free or discounted access at our discretion, and we may end it at any time.

Intellectual property

Macro Marmot, including its software, design, logos, and brand, is owned by RoushTech, LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding. We grant you a limited, revocable, non-transferable license to use the app for personal, non-commercial use under these Terms.

Service availability

We work to keep Macro Marmot available and reliable, but we provide it on an "as available" basis. We may change, suspend, or discontinue features, and we may limit availability or perform maintenance.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app's estimates are accurate or that the service will be uninterrupted or error-free. Food database information comes from third-party sources and may be incomplete or incorrect.

Limitation of liability

To the fullest extent permitted by law, RoushTech, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or twenty-five US dollars (US $25). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless RoushTech, LLC from claims arising out of your misuse of the service or your violation of these Terms or of any law or third-party right.

Termination

You may stop using Macro Marmot and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the service in a way that risks harm to others or to the service. On termination, the provisions that by their nature should survive will survive.

Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Hamilton County, Tennessee for disputes that are not otherwise subject to a binding alternative process.

Changes to these Terms

We may update these Terms as the service evolves. We will revise the "Last updated" date and, for material changes, provide more prominent notice. Continuing to use Macro Marmot after changes take effect means you accept them.
